In one case, the supreme court actually refused to rule on secession.
In one case the court said that in 1860 secession legal. The north
made “null and void” all the laws of the confederacy, thus nullifying
the Confederacy itself. In other words the North used “nullification”.
In essence, the success of any secession determines its legality.
