i have a problem with the constitutional amendment proposed on free talk live’s 6/17 show.
1: the govt rarely obeys the constitution now, so there is a very high probability of them not following the new amendment.
2: a federal sales tax would violate the the current constitution, not that they care about that ancient outdated piece of paper anyways.
C: the govt wont give up all the dependable revenue that all the taxes the sales tax would replace.
edit:
2 examples of them not following the constitution:
1: the ACA , which was ruled a tax by the supreme court , is unconstitutional as all revenue bills must originate in the house of representatives. the ACA originated in the senate.
2: recent federal court decision that “allows” states to place a sales tax on out of state purchases.
article 1 section 10 clause 2 states:
“No State shall, without the Consent of the Congress, lay any Imposts or Duties on Imports or Exports, except what may be absolutely necessary for executing it’s inspection Laws: and the net Produce of all Duties and Imposts, laid by any State on Imports or Exports, shall be for the Use of the Treasury of the United States; and all such Laws shall be subject to the Revision and Controul of the Congress.”
note:
“all such Laws shall be subject to the Revision and Controul of the Congress.”
Congress , not the courts.
