If there is nothing to hide Mackler, why did I receive a Motion Of Exclusion Of Witnesses Pending Disclosure today?

Claiming that if we call witnesses without providing him with a written disclosure of facts we hope to prove in court, it will be unfair. What they say might surprise you and that it will leave you unprepared for trial? If you have done nothing wrong, how will you be surprised and unprepared for trial? In discovery you asked Curtis and myself about Jacob and now you are hoping to keep him from taking the stand in court??

The judge specifically stated he wanted to hear from Jake and that seemed to be his main reason for the continuance.

I am also waiting for your responses to my interrogatories and admissions, I would appreciate if you could get those to me as soon as possible.

Why don't you post Mackler's Motion and your disclosures so we know exactly what is stated in each?

Trial is the first day of liberty forum at 1pm. We will probably be the last case to be heard that day. Not sure how many other cases are scheduled for the 23rd.

As far as a digital camera goes, I am waiting on a new compact flash card as mine is totally corrupted and my camera is useless without one.


I would like to point out that if I was just trying to be a dick, I would not be putting so much work into this case. Responding to discovery requests, writing my own discovery requests and responding to motions. I am not a lawyer, and I have not taken a law class since high school, the amount of time and effort I have put into this is not something I would do just to ruffle someones feathers. I really could think of a million better things to spend my time on...

I am ready for this to come to a conclusion, this whole mess has set off a chain reaction of bullshit not related at all to the situation with this house and I am exhausted.

Clearly that audio is evidence of an eviction suit instituted by Adam against Jacob.

This thread is retarded.  Why  should Mackler mention the recording, he isn't the one that requested it.

Both parties are violating private property rights, neither side has a "right" to stay there.  The bank has foreclosed on the house, Mackler is trying to keep it by some shitty argument of "show me the list of corporations that have been lien/deed holders", and do I really need to argue on how Curtis & Robin are being shitty by thinking they are entitled to stay there rent free?

Both of 'em need to get the fuck out.

PS...Robin, "your" camera also works on a SD card, just use that, it's much cheaper.

Commie, the recording is proof there was an eviction case between Mackler and Jake. His website clearly leaves out the fact that he did take Jake to court for an eviction on November 1st a month and a half prior to the bank doing so.

Well we get to the court to check in and Mackler finally gives us answers to the interrogatories and admissions we sent him right before the hearing is supposed to take place. The judge ruled that he can not rule on the case at this time because there is a case pending between the bank and Mackler in superior court that has to be settled first. He said that it would be unfair to ask us to pay Mackler anything until it is determined who is in fact entitled to rent payments. If the bank wins it's case against Mackler, it will be the bank that is owed rent and not Mackler. Neither side had a chance to make arguments. There will be video soon, but it was pretty uneventful. To the best of my knowledge Mackler was ordered by the court a while back to pay a recognizance to the bank. If I understand what the judge said correctly, paying recognizance is not the same thing as paying the bank rent.
